Customer Terms and Data License

Version 1.0, effective 29 September 2026

1. These terms

These terms apply to every paid product and service from Heimdall Research ("we"), including those we add in the future: one-time reports, subscriptions of any kind, paid API and AI assistant access, data deliveries, licensed data products, and paid features in the customer portal. By paying, or by ticking "I agree" at checkout, you accept them on behalf of your organization ("you"). A signed order form or quote overrides these terms only where it says so.

Free open datasets are not covered by these terms. They are published under the Creative Commons Attribution 4.0 license stated with each dataset.

2. What you get

What you get is what the product page, plans page, checkout, or order form describes at the time you buy. For example:

• Storm reports: a PDF report and data files for one named storm, priced by the number of FEMA-declared counties, with free updated versions for 12 months after purchase.
• Subscriptions: access for the subscription term to the products and coverage you chose, such as the states in a regional storm plan, the lakes in a lakes plan, or higher API limits.
• Licensed products and new products: what the quote, order form, or product page describes. These terms cover them unless the order form says otherwise.

3. Your license

For everything you buy, including data, reports, files, API responses, and imagery, we grant your organization a non-exclusive, non-transferable license to use it for its internal business purposes. Your employees and contractors may use it on your behalf.

You may use the data and reports inside your organization, and you may put results you derive from them (your own analysis, charts, summary figures, and short excerpts) into your own work products, including reports to your clients, with the credit "Source: Heimdall Research".

You may not:

• share, publish, resell, sublicense, or give the report or data files, or any substantial part of them, to anyone outside your organization;
• post them publicly or put them in a shared repository, data marketplace, or public AI tool;
• use them to build or sell a competing dataset or product;
• remove or alter the "Licensed to" notice, credits, or source notes;
• share your API keys or account access outside your organization.

We keep all rights not granted here. Each report is marked "Licensed to [your organization] for internal use."

4. How long the license lasts

• One-time purchases (such as a report): your license to use it internally continues after purchase with no end date, as long as you follow these terms.
• Subscriptions and ongoing access (including paid API access): access lasts while the subscription is active. After it ends, you may keep using internally the copies you downloaded during the term; you do not get new data or continued API access.
• If you break these terms, we may end the license, and you must stop using and delete the affected material.

5. Payment

• Prices are in U.S. dollars, plus any applicable sales tax. Payment is by card or U.S. bank account at checkout, or by invoice where agreed.
• Subscriptions renew automatically until you cancel. You can cancel at any time in the customer portal; access continues to the end of the paid period.
• If a payment fails, we retry and email you. If it is not resolved within 14 days, paid access pauses until it is.
• Report credit: if you buy a report and start a subscription within 30 days, the report price is credited to your next subscription invoice.

6. Your account

You are responsible for your account and for all use under your API keys. Keep keys confidential and replace a key right away if it may have leaked. Usage limits apply as listed on the plans page.

7. The data and its limits

Our data is research data derived from satellite and public records. It is provided "as is", without warranty of accuracy, completeness, or fitness for a particular purpose. Each product states its method, validation, and known limits, and we correct errors in the open with versioned releases.

Our data is not for navigation, life-safety or emergency dispatch decisions, engineering design, regulatory filings without your own verification, or legal determinations. You are responsible for how you use it.

8. Refunds

• One-time purchases such as reports: if a purchase cannot be delivered, or has a material error we cannot correct within 10 business days of your notice, we refund it in full. Otherwise reports are non-refundable once the download link has been used.
• Subscriptions: cancel any time; no charge after the current period. For yearly plans, a full refund if you cancel within 14 days of the first payment and have not downloaded data; no prorated refunds after that.
• Licensed products: as stated in your order form.

9. Limitation of liability

To the extent the law allows, our total liability for any claim relating to what you bought is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect, incidental, special, or consequential damages, or for lost profits or data.

10. Suspension and termination

We may suspend access for non-payment, breach of these terms, or to protect the service. We may end these terms for a material breach that is not fixed within 10 days of notice. Sections 3 (restrictions), 4, 7, 9, and 12 continue after termination.

11. Privacy

The privacy page describes how we handle account information.

12. General

These terms are governed by the laws of the State of Colorado, United States. We may update these terms; the version in effect when you buy applies to that purchase, and changes to subscription terms take effect at your next renewal after notice. Questions: [email protected].
